Terms of Service

By accessing or using MemoryStory AI (“the Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the Service.

These Terms constitute a legally binding agreement between you and MemoryStory AI. We may update them from time to time — continued use after changes take effect constitutes acceptance.

MemoryStory AI is an AI-powered photo story platform. Our current commercial launch is StoryMe: a one-time digital unlock for personalized illustrated bedtime and gift stories created from child photos.

The Service currently includes story generation, previewing, digital unlocking, and digital sharing. Print ordering is disabled during the launch and may return later.

You must be at least 13 years of age to use the Service. By using the Service, you represent that you meet this requirement.

You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. Notify us immediately at support@memorystory.ai if you suspect unauthorised access.

We reserve the right to suspend or terminate accounts that violate these Terms.

Ownership

You retain full ownership of the photos you upload and the stories generated from them. We claim no ownership over your content.

Licence you grant us

By uploading content, you grant MemoryStory AI a limited, non-exclusive, royalty-free licence to store, process, and display your content solely for the purpose of providing the Service to you. This licence ends when you delete the content or close your account.

Your responsibilities

You represent and warrant that:

• You own or have the rights to all photos you upload
• Your content does not infringe any third-party intellectual property rights
• Your content does not contain illegal, harmful, or offensive material
• You have obtained consent from any identifiable individuals photographed, including guardian permission where required by law

You agree not to use the Service to:

• Upload photos depicting illegal content, including child sexual abuse material (CSAM)
• Upload photos of individuals without their consent where consent is legally required
• Violate any applicable law or regulation
• Attempt to reverse-engineer, scrape, or disrupt the Service
• Use the Service to generate content that harasses, defames, or harms others
• Resell or sublicense access to the Service without our written permission

We reserve the right to remove content and terminate accounts that violate these prohibitions, without notice or refund.

Stories, captions, and narrative text generated by our AI are produced automatically and may occasionally contain errors, inaccuracies, or content that does not accurately reflect your photos. You are responsible for reviewing and editing generated content before sharing or printing.

AI-generated content does not constitute professional advice of any kind. Do not use it as such.

We do not guarantee any particular output quality, tone, or result from AI generation. Generation requests may fail or produce unexpected results.

Printed books are currently disabled during our digital-only launch. The terms below apply only if and when print ordering is re-enabled.

You are responsible for ensuring the content in your story is accurate and appropriate before ordering. We cannot refund orders for content you approved and submitted.

Refunds and returns

If print ordering returns and your book arrives damaged or defective, contact us within 14 days of delivery at support@memorystory.ai with photos of the issue. We will arrange a replacement or refund at our discretion.

Because printed books are personalised goods, we cannot accept returns or issue refunds for reasons other than defects or non-delivery, in accordance with applicable consumer protection law.

Delivery

Delivery timelines are estimates and are not guaranteed. We are not liable for delays caused by shipping carriers or customs.

Stories shared via unique links are accessible to anyone with the link. Do not share stories containing sensitive personal information you would not want strangers to see. If you need a shared link removed, contact support and we will disable it for you.

Payments are processed securely by Freemius. By completing a purchase, you also agree to Freemius' terms of service. All prices are displayed in US dollars unless stated otherwise.

The current launch offer is a one-time StoryMe Digital Unlock. We do not currently offer subscriptions, bundles, credits, or physical fulfillment through checkout.

Accidental duplicate purchases or technical billing issues should be reported to support@memorystory.ai within 14 days.

The MemoryStory AI name, logo, platform design, and all associated software are the intellectual property of MemoryStory AI and may not be copied, reproduced, or used without our written permission.

The Service is provided “as is” and “as available” without warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted, error-free, or free of viruses.

To the maximum extent permitted by applicable law, MemoryStory AI disclaims all implied warranties including merchantability, fitness for a particular purpose, and non-infringement.

To the maximum extent permitted by law, MemoryStory AI shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, loss of revenue, or loss of goodwill, arising from your use of the Service.

Our total liability to you for any claim arising out of or relating to the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

You agree to indemnify and hold harmless MemoryStory AI and its employees from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Service, your content, or your violation of these Terms.

You may stop using the Service and close your account at any time. We may suspend or terminate your access at any time if you violate these Terms, with or without notice.

Upon termination, your right to access the Service ends immediately. We may retain certain data as required by law.

These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales, unless applicable consumer protection law in your country provides otherwise.
